Got a new laptop but was a waste of money

I could really use some advice and insights from the community. About two weeks ago, I got my first laptop, an Asus Vivobook 14, which my uncle bought brand new from a Croma store in Delhi. It was around ₹50,000, so definitely not a small amount for us.

Just a few days after using it, I started noticing issues with the trackpad – it would often get stuck, the screen would buffer, and there were times when the whole system slowed down, with the cursor freezing in the middle of the screen. Initially, I thought it might just need an update, and after updating, it seemed okay for a bit, but the problems kept coming back.

My uncle contacted Asus customer care, and they guided us through a reset, which again temporarily fixed the issue. But the very next day, while I was taking an online lecture, the same problems occurred. My brother suggested I use a mouse alongside, but that’s not really a solution for me.

We took the laptop back to the Croma store and explained everything. They mentioned that since it’s under a 3-year warranty, they’ll send it to the company for repair. But here’s the thing: it’s only been two weeks, and I’m really not comfortable with the idea of having my brand new laptop repaired instead of exchanged. It feels wrong, especially considering how much I was looking forward to this, and ₹50,000 isn’t a small amount for us.

It’s been four days since they sent the laptop off, and I’m just sitting here with no idea when or how I’ll get it back. I’m honestly quite frustrated and don’t want a “repaired” device when it was faulty right out of the box.

Has anyone else been in a similar situation? Is there anything I can do to push for an exchange instead of a repair? What are my rights here? Any advice or shared experiences would be really appreciated!
