Can you really make up rules on the MEE?

Just took the Themis Simulated MEE and boy... that was horrible.

I didn't know a lot of law so I made up rules that I thought the facts suggested. My friend said he looked at NCBE point rubrics and found that getting the rule statements right was only worth a few points (one per rule), but that applying each of the facts in the case - even to your incorrect rule - was worth one point each. So I made sure to use all the facts in each case.

People who passed the bar - DOES THIS ACTUALLY WORK? Can you still score a 4 or something while making up some rules if you analyze all the facts?
