Council Threatening To Make British Child Homeless

Hi everyone,

I’m in a critical situation and need urgent advice. My child is a British citizen, but the council is planning to evict them and their mother from temporary accommodation on 26 January 2025, leaving them homeless. The council is refusing to fulfill their legal obligations under the Children Act 1989, which requires them to safeguard children in need.

The issue is that my ex-partner’s visa has expired, and she has No Recourse to Public Funds (NRPF). The council is using this as an excuse to claim the situation is an “immigration issue” and not their responsibility. However, this completely ignores my child’s status as a British citizen, which should ensure their rights to housing and welfare are protected. It feels like they’re punishing my child for their mother’s immigration status, which is not only cruel but a clear violation of the law.

Sadly, I cannot afford a solicitor, and the ones I’ve approached have either said they can’t take on the case or can’t act in time. I’m feeling completely overwhelmed, with no idea what steps to take before the eviction date.

I would be so grateful for any help, advice, or guidance on what to do in this situation.
