DACA criminal record

Hello! I am posting this for my fiance, he got in trouble in 2022 and is on probation with a monitor until 2026. He thought he would be denied DACA renewal but renewed in 2024 with no issue so he has a current DACA/Work Permit. We did not do AP as every lawyer we spoke to said it was about 50/50 of him being denied entry back.

Anyways, ICE has been spotted in our town and I’m wondering when they say they are coming after those with a record are people on DACA with a record safe? Trying not to panic but trying to weigh options and see how at risk he is for being detained/deported. He said he will fight to the end and will not go back without a fight, but if it comes down to it I US citizen would rather be together with him in Mexico then have us separated for how knows long etc.

Also YES!! we are in process of getting married, I’m in school so didn’t want his income to affect my financial aid. Do you think being married to a citizen helps at all even though we haven’t done AP?
